Descriptions of the panels

  • Patenting, Branding, and Advertising in the Age of Green Claims: An Intellectual Property Perspective from the Cosmetics & Healthcare Industry: This panel would explore how various branches of intellectual property law intersect with environmental and ethical marketing claims in the cosmetics sector.
  • The long arm of the UPC and its impact on European litigation strategies: This panel will analyze the ECJ decision BSH v Electrolux which clarified the possibilities of cross-border injunctions for European patents, discuss the UPC and national decisions that followed, and finally assess the possibilities and risks arising from the increasing reach of European patent fora.
  • Luxury on Trial: Free Riding and the Battle Over Fashion Design in Europe’s Style Capitals: Who owns creativity in fashion? As Europe’s courts and regulators grapple with the blurred lines between inspiration and imitation, the industry faces unprecedented legal and cultural challenges. From the protectability of shapes and designs to the limits of copyright, trade mark, and unfair competition law, the boundaries of fashion’s legal framework are being redrawn. This panel will explore how recent cases are reshaping the balance between artistic freedom, sustainability, and the preservation of luxury.
  • Procedural aspects of IP dispute in the age of AI: This panel explores the procedural challenges encountered by copyright holders in cases of AI-related dispute. Key topics include accessing evidence and enforcing rights when dealing with the complexities of AI’s “black box” nature.
