Criminal protection of industrial property titles beyond the scope of civil counterfeiting: Article 517-ter of the Italian Criminal Code
The IP Criminal Law Group operating within the AIPPI Italian Group has recently conducted a study into the offence referred to in Article 517-ter of the Italian Criminal Code (“ICC”), which punishes the manufacture and sale of goods in breach of industrial property titles (patents, registered trademarks, registered designs and models, registered topographies of semiconductor products – Article 2, paragraphs 1, 2, 3 and 5 of the Italian Industrial Property Code – “IIPC”).

IP High Court Revokes JPO Decision, Upholding Validity of Priority Claims for Broad Institute’s CRISPR-Cas9 Patent
On 24 March 2026, the Intellectual Property High Court of Japan rendered a judgment revoking the trial decision of the Japan Patent Office (JPO), which had invalidated a patent related to CRISPR-Cas9 jointly owned by The Broad Institute, Inc. (“Broad”), Massachusetts Institute of Technology (“MIT”), and the President and Fellows of Harvard College (“Harvard”, collectively referred to as the “Patentees”).

Kazakhstan Adopts New Rules for Recognition of Well-Known Trade Marks
Effective 10 February 2026, Kazakhstan enacted new Rules on the recognition of trade marks as well-known, by Order of the Minister of Justice No. 97, dated 28 January 2026. Adopted in accordance with Kazakhstan’s Law on Trade Marks, Service Marks and Appellations of Origin of Goods, the Rules establish a more structured and evidence-based framework for obtaining well-known trade mark status.
