The Unified Patent Court is rapidly developing its own approach to the quantification of damages for patent infringement. As the Court’s early case law on damages takes shape, it is time to examine how the UPC, while applying its own rules, may nonetheless be influenced by established traditions of its key Member States. The roundtable will explore the Italian, French, and German approaches to damages calculation, and assess how and to what extent they can shape the UPC’s emerging case law. Panelists will discuss topics such as lost profits, moral damages, reasonable royalties, and disgorgement of profits.
