UAE’s New Accelerated Patent Grant Programme: A Faster Patent Grant—or Simply a Smarter Examination Process?

“Accelerated Patent Grant.” At first glance, the name suggests one thing: a faster route to obtaining a patent in the UAE.

For many applicants, that assumption seems perfectly reasonable. After all, “accelerated” naturally implies that an application will move to the front of the examination queue.

However, that is not quite how the UAE’s newly introduced Accelerated Patent Grant (APG) Programme operates.

While the programme marks another significant milestone in the UAE’s efforts to modernize its intellectual property framework, it is designed to accelerate how an application is examined—not necessarily when it is examined.

Understanding this distinction is essential for businesses, innovators, and patent professionals seeking to maximize the benefits of the UAE’s evolving patent system.

Strengthening the UAE’s Innovation Ecosystem

As part of this ongoing transformation, the UAE Ministry of Economy introduced the Accelerated Patent Grant Programme alongside enhanced cooperation with leading international patent offices, including the United States Patent and Trademark Office (USPTO).

This initiative was formalized through a Joint Statement of Intent signed on 20 July 2025 between the UAE Ministry of Economy and Tourism and the USPTO during the 66th Assemblies of the Member States of WIPO in Geneva.

The cooperation framework enables the UAE Patent Office to consider positive examination results issued by the USPTO for corresponding UAE patent applications, provided that the application satisfies all applicable UAE legal and procedural requirements.

This reflects the UAE’s broader commitment to aligning its patent system with international best practices while improving examination efficiency for applicants pursuing global patent protection.

The Biggest Misconception About the APG Programme

Since its introduction, one question has surfaced repeatedly among applicants:

Does filing an APG request automatically result in expedited examination?

The answer is no.

Although the programme is called the Accelerated Patent Grant Programme, the UAE Patent Office has clarified through its published Guidelines that an APG request does not place an application into a priority examination queue.

Instead, applications submitted under the APG Programme continue to proceed through the Patent Office’s standard examination timeline.

The “acceleration” comes later in the process.

Rather than shortening the waiting period before examination begins, the programme reduces duplication during substantive examination by allowing the UAE Patent Office to rely on certain findings already reached by a cooperating foreign patent office.

In other words, the examination itself becomes more efficient—not necessarily earlier.

This distinction is subtle but extremely important for applicants developing their patent filing strategy.

APG vs. Express Examination: Two Different Paths

One of the most important aspects of the new framework is understanding the difference between an Accelerated Patent Grant request and an Express Examination request.

Although both mechanisms are intended to improve efficiency, they serve fundamentally different purposes.

Under the UAE Patent Office’s APG Guidelines, eligible applicants may request accelerated grant by submitting evidence of a corresponding foreign application that has received a positive examination outcome from a cooperating patent office, such as the USPTO.

However, this procedure does not alter the application’s position in the examination queue.

By contrast, applicants seeking priority examination must file a separate Express Examination request under Article 14 of Federal Law No. 11 of 2021 and Article 38 of Regulation No. 6 of 2022, together with payment of the prescribed official fee.

Express Examination places the application into a separate examination queue, enabling the Patent Office to begin examination earlier than under the standard process.

The distinction is therefore straightforward:

• Express Examination accelerates when examination begins.
• The APG Programme accelerates how examination is conducted.

Understanding the difference allows applicants to make informed strategic decisions based on their commercial objectives.

So, How Does the APG Programme Save Time?

The real value of the APG Programme lies in eliminating unnecessary duplication.

Where an applicant has already obtained a positive examination result from a cooperating foreign patent office, the UAE Patent Office may rely on that earlier examination when assessing the corresponding UAE application.

In particular, the Patent Office may accept previous findings relating to novelty and inventive step, provided the requirements of the programme are fully satisfied.

This allows UAE examiners to focus on matters that remain subject to UAE law rather than repeating an assessment that has already been completed elsewhere.

Applicants should note, however, that participation in the APG Programme does not exempt an application from compliance with UAE Industrial Property Law.

The application must still satisfy all applicable formal requirements, as well as any substantive legal requirements that remain within the scope of examination under UAE legislation.

Accordingly, while the APG Programme does not guarantee an earlier examination date, it has the potential to shorten the overall prosecution process once examination begins by reducing repetitive substantive review.

UAE–USPTO Cooperation: A Strategic Advantage

The APG Programme represents more than an administrative improvement—it reflects the UAE’s growing integration with the international patent system.
